HASBA Act, a step to create rift in the federal character of the State
Islamabad. Imposition of HASBA Act will cause rift in the three pillars of the state i.e. executive, legislature and judiciary. Parliamentarians Commission for Human Rights has expressed its deep concerns and said the sideling opposition and ignoring the will of the people is an undemocratic practice especially on the issues of national concern and solidarity. Chairman PCHR Mr. Riaz Fatyana MNA, said that the purpose of any legislation is to bring about harmony and stability in policies of the state, and the introduction of HASBA law is a passion out of reason. In fact, laws works only when they carried out with the consensus of all parties in the parliament, he urged.
Mr. Riaz Fatyana maintained that the conflicting nature of Hasba Act violates basic human rights, because it is inconsistent with the fundamental rights ensured to be protected in the Constitution of Pakistan. He also added that proposed Hasba Act is replica and continuity of Nawaz Sharif’s Shariat Bill and its real motive is to establish personal rule only.
Mr. Chairman also said that the way in which the government of MMA-P in NWFP is adamant upon enforcing Hasba Act is entirely undemocratic practice. Instead of providing justice to the people, the proposed act will play havoc with the existing law in the country. He said that the act would make dent on least developed federal unity of the country leading to confrontation between the center and federating units.
Mr. Riaz Fatyana MNA, said that it is duty of the provincial government of MMA in NWFP to observe the reservations of the opposition in the province particularly when the federal government and Islamic Ideology Council of Pakistan have expressed their unvague standpoint calling it disputed. He further added that it is need of the time that MMA government adopt the course of reconciliation for abolishing the doubts and apprehensions of opposition parties on the act.
While Criticizing the proposed Act, Mr. Chairman remarked that it is time-wasting activity to indulge in polemics instead of adopting the way of reconciliation. He made clear that the laws the proposed act is concerned with are already in vogue. He called upon the MMA government in NWFP to ponder on the issue with sanity and have recourse to moderation and reconciliation.
